TURKPATENT – Updated Trademark Examination Guidelines

The updated version of Trademark Examination Guidelines concerning the proceedings before the Turkish Patent and Trademark Office were published on September 30th, 2019.

The Guidelines have been drawn up to clarify the examination principles under Article 5 of the Turkish IP Law No. 6769 “Reasons for asolute rejection of trademark registration”, and thus to maximize the compliance of the Office decisions regarding trademark prosecution.

In the updated guidelines having 387 pages -comparing with its earlier version of 2011- the subjects were examined under more headings together with more real-case examples based on latest Court and Office decisions in Turkey and European Union authorities.
